Overview

Tality LLC, d/b/a Tality.ai (“Tality.ai,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. It applies to our websites, applications, AI agents, voice services, messaging programs, and related services (collectively, the “Services”).

By using the Services or providing your information to us, you acknowledge that your information will be handled as described in this Privacy Policy.

Information We Collect

We collect the following categories of information:

Information you provide directly

  • Contact information. Your name, email address, mobile phone number, business name, business size or number of locations, and any other details you submit through our forms (for example, when booking a demo).
  • SMS opt-in and consent records. When you opt in to receive text messages, we record the date and time of consent, the source of opt-in, the language of the consent disclosure shown to you, and the IP address used.
  • Voice and message content. If you call, message, or chat with us, we collect the content of those communications, including transcripts and recordings where applicable.
  • Account & billing information. If you become a customer, we collect business contact details, billing information, and any data you submit through the Services.

Information collected automatically

  • Usage data. Pages visited, links clicked, referring URLs, browser and device type, operating system, IP address, and approximate location derived from IP.
  • Cookies and similar technologies. See “Cookies and tracking” below.

Customer end-user data

When our customers use the Services to communicate with their own end customers, those end customers’ data is processed by us on the customer’s behalf as a processor / service provider. The customer is the controller of that data and is responsible for any required notices and consents.

How We Use Information

We use information for the following purposes:

  • to provide, operate, and improve the Services;
  • to respond to your inquiries, schedule demos, and send transactional messages such as booking confirmations and account-related communications;
  • to send marketing communications (where you have opted in) about new features, events, and offers;
  • to operate the SMS messaging program, including sending you the messages you signed up for and processing STOP/HELP requests;
  • to monitor, secure, and protect the Services and prevent fraud or abuse;
  • to comply with legal obligations and enforce our Terms.

SMS Program Privacy

The following clauses apply specifically to the Tality.ai SMS program and supplement the rest of this Privacy Policy.

Mobile information sharing — our commitment

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Permitted subprocessors

To deliver text messages we work with a small number of carefully selected subprocessors (for example, Twilio, our SMS gateway). These subprocessors are bound by contract to process mobile information only on our instructions and only as necessary to operate the Program. They may not use or sell that information for their own marketing purposes.

Consent records

We retain a record of your SMS consent (including the language of the disclosure, the source, and the timestamp) for as long as you remain opted in and for a reasonable period afterward in order to demonstrate compliance with applicable law.

Opting out

You can opt out of the SMS program at any time by replying STOP to any message you receive from us. You will receive a confirmation message and no further SMS messages will be sent through the Program. Opting out of SMS does not affect transactional email or your account in other respects. Message and data rates

Message and data rates may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages.

How We Share Information

We do not sell or rent your personal information. We share information only as described below.

  • Service providers / subprocessors. Vendors that host our infrastructure, send messages on our behalf (such as Twilio), process payments, deliver email, and provide analytics. Each is bound by contract to process information only as needed to provide their service.
  • With your direction. Where you direct us to share information (for example, with a CRM or integration you have authorized).
  • Legal & safety. Where we reasonably believe disclosure is required by law, legal process, or to protect the rights, property, or safety of Tality.ai, our users, or others.
  • Business transfers. In connection with a merger, acquisition, or sale of assets, subject to a successor entity continuing to honor this Privacy Policy.

For the avoidance of doubt: mobile opt-in data and SMS consent records are not shared with third parties or affiliates for marketing or promotional purposes under any circumstance.

Cookies & Tracking

We use cookies and similar technologies to operate our website, remember your preferences, measure performance, and (where you consent) personalize content. You can manage cookies through your browser. Disabling certain cookies may affect parts of the Services.

Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by data type — for example, we retain SMS consent records as needed to demonstrate compliance with applicable messaging laws.

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and monitoring. No system is completely secure; we cannot guarantee absolute security.

Your Privacy Rights

Depending on where you live, you may have rights under the California Consumer Privacy Act (CCPA/CPRA), the Virginia Consumer Data Protection Act, the GDPR, or similar laws, including the right to access, correct, delete, or port your personal information, and to object to or restrict certain processing.

To exercise these rights, contact us at info@tality.ai. We will respond within the timeframes required by applicable law. We will not discriminate against you for exercising your rights.

Do Not Sell or Share / opt-out of targeted advertising: Tality.ai does not sell your personal information and does not share it for cross-context behavioral advertising.

Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us so we can delete it.

International Users

Tality.ai is operated in the United States. If you access the Services from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Updated” date at the top of this page. Material changes will be communicated through the Services or by email where required.
